Terms of Service
Last updated: [DATE]
Welcome to L'Arte Classica. These Terms of Service ("Terms") govern your use of our website and your purchase of our marble sculptures, fountains, columns and related works ("Pieces"). By placing an order with us, you agree to these Terms. Please read them carefully. Nothing in these Terms affects your statutory rights under UK consumer law.
In these Terms, "we", "us" and "our" refer to L'Arte Classica; "you" refers to the customer placing an order.
1. Our Pieces
Each Piece is hand-carved from natural marble by master artisans. Because marble is a natural material and every work is finished by hand, slight variations in veining, colour, dimensions and finish are inherent and expected. These variations are a mark of authenticity, not a defect. Photographs on our website are representative; your Piece will be uniquely its own.
The majority of our Pieces are made to order, or made to a specification you select (such as size, marble type, finish or base).
2. Pricing and Currency
Prices are displayed in the currency selected on our website and are inclusive or exclusive of taxes as indicated at checkout. Applicable taxes, duties and any shipping charges are confirmed before final payment.
We take care to price accurately, but in the event of a genuine pricing error we reserve the right to cancel the affected order and refund any sum paid. Prices may change at any time, but changes will not affect orders we have already confirmed.
3. Orders and Acceptance
Your order is an offer to purchase. A contract is formed only when we confirm acceptance of your order, or — for higher-value commissions — once your reservation deposit is received and we confirm production. We reserve the right to decline any order.
4. Payment Methods
We offer the following payment structure according to the value of your order:
Orders up to €2,000 (or local-currency equivalent). Payment is taken in full by credit or debit card at the time of checkout.
Orders above €2,000 (or local-currency equivalent). To reserve your Piece, a deposit of €500 is taken by credit or debit card at checkout. This deposit is non-refundable (see Section 5). After your order is placed, our team will email you secure bank transfer / wire instructions for the remaining balance, which is due within 7 to 10 days of your order. Production and dispatch begin only once the full balance has cleared.
We accept payment by the methods displayed at checkout. Bank transfer details are sent securely by email and are never published on our website. Title to the Piece does not pass to you until we have received payment in full.
5. Reservation Deposits
For orders above €2,000, the €500 deposit is non-refundable. It secures your Piece, reserves production capacity and covers the preparation of your commission.
If the balance is not paid within the stated period, or you choose not to proceed, the deposit is forfeited and the order may be cancelled. The deposit is applied toward the total price of your order when the balance is paid.
6. Production and Lead Times
As each Piece is carved by hand, production typically takes approximately [6–10 weeks], after which shipping time applies. Lead times are estimates given in good faith and are not guaranteed. We will keep you informed of progress and notify you of any material delay.
7. Shipping and Delivery
Shipping is arranged by fully insured freight, with transit times shown at checkout. Transit time is additional to production time. Risk in the Piece passes to you on delivery. Please inspect your Piece on arrival and report any damage in accordance with our Refund & Returns Policy.
8. Returns, Cancellations and Refunds
Your rights to cancel, return and obtain a refund — including the treatment of made-to-order and in-stock Pieces — are set out in full in our Refund & Returns Policy, which forms part of these Terms. In summary, made-to-order and bespoke Pieces are final sale, while in-stock Pieces may be cancelled within 14 days of delivery; all Pieces are protected if they arrive damaged, faulty or not as described.
9. Intellectual Property
All content on this website — including images, text, designs and the L'Arte Classica name and branding — is our property or used under licence, and may not be reproduced without our written permission.
10. Our Liability
We are responsible for foreseeable loss caused by our breach of these Terms, but we do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud. We are not liable for damage resulting from improper installation, handling, cleaning, or outdoor exposure contrary to our care guidance. Marble is a heavy and delicate material; safe siting and installation are your responsibility.
11. Governing Law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts. This does not deprive you of any protection afforded by the mandatory consumer laws of your country of residence.
